Suing for personal injury compensation

Suing for personal injury compensation has been made easier by the establishment of the InjuriesBoard.ie (the Board). Formerly known as the Personal Injuries Assessment Board (PIAB), the Board is an independent statutory body set up to assesses the amount of compensation due to a person who has suffered a personal injury. Many countries do not have such a board, relying instead on the long and costly court process to decide the amount of compensation payable.

Claiming personal injury compensation through the Board

To commence a personal injury compensation claim through the Board, the applicant (the injured person) should contact the respondent as soon as possible after the incident to notify of their intention to make a claim. This should be done in writing within two months of the incident. You may wish to instruct a personal injury solicitor to contact the respondent. Your personal injury solicitor may advise you to attempt to settle the matter out of court.

To make a personal injury compensation claim through the Board, the applicant must submit an application to the Board. This can be done either online or by post. The forms are available over the internet or by contacting the Board. Many people prefer to get a personal injury solicitor to fill out the appropriate forms and to liaise with the respondent and the Board on their behalf.  The main documents required at the application stage includes a completed application form (Form A) and a medical assessment form (Form B) completed by the applicant’s treating doctor. Payment also needs to be submitted with the claim (currently €45).

Time limit for making a personal injury claim

The absolute maximum time frame for making a personal injury claim (unless any legal exceptions apply) is two years from the date of the accident. However, it is highly advisable to make the application as soon as possible after the incident and well before the expiration of the two year limitation period. The Board is usually able to resolve claims within nine months.

It is important to remember to obtain as much evidence supportive of your claim as possible, including incident reports, witness reports, medical reports and receipts. This will ensure your claim proceeds as smoothly as possible through the system.
