When making a personal injury claim, getting the person responsible to admit liability for the injuries and losses caused by the accident is only half of the legal battle. Determining the amount of personal injury compensation to which a person is entitled to for those injuries and losses is the other half of that legal battle, and by no means an easy part of the process.

Amount of personal injury compensation

The amount of compensation payable for a particular injury or loss varies from case to case. Whilst there are guidelines, and previous cases serve as a basis for predicting future cases, each case will still be determined on its own merits. This means that the particular personal and situational circumstances of the incident and the person injured will be taken into account.

In Ireland, very useful assistance is provided by the (the Board). Formerly known as the Personal Injuries Assessment Board (PIAB), the Board is an independent statutory body which provides an independent assessment of personal injury claims for compensation for a variety of accidents and incidents. The Board was set up under the Personal Injuries Assessment Board Act 2003.

The Board assesses all claims (except for medical negligence claims) where the respondent agrees that they are liable for the injury and consents to submit the claim to the Board for determination of the amount of compensation payable. Therefore, the Board is only able to assess the quantum of compensation payable and not more fundamental questions regarding liability. If liability is contested, or if the respondent does not consent to submit the matter to the Board for assessment, then the case will have to go to court.

In order to ensure the issue is resolved quickly and everyone can get on with their lives, it is desirable that the matter goes to the Board for assessment. This is because, on average, claims submitted to the Board are assessed within 7 months of submission, whereas claims can take up to 3 years to process through the court system. The legal costs associated with litigating the matter through the court system are substantial.
