Can I lose my home if I am unable to keep up my mortgage repayments?

Generally, if you can’t keep up the payments on your mortgage, your mortgage lender will eventually take steps to repossess your home. If you do find that you are having difficulty paying your mortgage, you should initially contact your mortgage lender, as they have a duty to help you find a way of resolving the problems you are having making your repayments.

You could also take legal advice from a mortgage and repossessions solicitor. Along with the Money Advice and Budgeting Service (MABS), you can explain your particular circumstances and look for ways to resolve your mortgage difficulties. Your mortgage and repossession solicitor will explain that you are protected by consumer codes that have been drawn up by the Central Bank of Ireland.

How does the Code protect me from losing my home?

A mortgage and repossession solicitor can explain the code to you. The main part of the Code is that your mortgage lender must contact you as soon as arrears begin to appear on your account. They must also have a formal procedure to handle your mortgage arrears. The Code also compels your mortgage lender to wait for 12 months before they take legal action against you to repossess your home. If you need help understanding this process, repossession solicitors can be a great help.

In most cases if you work with your mortgage lender you will be able to come to what is called an ‘alternative arrangement’ about your arrears. Your repossessions solicitor will be an excellent source of information and advice throughout this process.

Mortgage lenders only use repossession as an absolute last resort. If you are falling into arrears with your repayments, contact a mortgage and repossession solicitor as soon as you can. The solicitor can assess your particular circumstances and offer their advice on the action you should take.
