Accidents in Public Places

In Ireland, accidents in public places commonly occur, causing injury to those involved. If you are injured in a public place, it is important to keep in mind that you may be entitled to compensation for your injuries.

Although many people are reluctant for Ireland to embrace the ‘litigation culture’ commonly attributed to the USA, it is important that those who are injured through no fault of their own are compensated for that loss. This is particularly important where the person has large medical bills to pay as a result and/or has lost their source of income due to their injuries.

Personal injury solicitors

Whilst information is available online, the best option is to speak to a personal injury solicitor about whether you might have a valid compensation claim. Your personal injury solicitor will look to see whether there is someone else who was at fault in causing you injury. For example, if you tripped over loose scaffolding in a public place, the personal injury solicitor will need to work out whether that occurred on public property and whether the scaffolding company or the property proprietor itself should be held responsible.

Most companies and even households now have public liability insurance. This means that usually your claim will be covered by that insurance company. If the insurance company disputes the claim then the matter may proceed to court. Your personal injury solicitor should be able to advise you from the outset whether the matter is likely to proceed to court or to settle out of court.

After your accident, be sure to take note of all of the details of the incident. You should report the injury to the property manager. They will usually take an incident report. You may also wish to take your own notes. If there were any witnesses, ask for their details so that you can obtain a witness report from them if required. You may also wish to take photographs as this may assist your claim.

Be sure to contact a personal injury solicitor shortly after your incident, as this will increase your chances of making a successful claim.
